1. Who we are

My Album (myalbumapp.com) is operated by MaDare unipessoal LDA, a company registered in Madeira, Portugal (NIF PT518470695). When you use My Album you are contracting with MaDare unipessoal LDA. Contact: support@myalbumapp.com.

2. Accepting these terms

By creating an account or continuing to use My Album, you agree to these terms. You must be at least 16 years old, or have permission from a parent or guardian, and if you use My Album for an organisation you confirm you may bind it to these terms.

3. The service

My Album lets you upload photographs, arrange them into digital albums styled like physical photo albums, and share view-only links. Free accounts include 1 album with up to 50 photos. Paid options add more albums and photos as described at the time of purchase.

4. Your account

Keep your login details confidential; you are responsible for activity under your account. Give accurate information and keep it up to date.

5. Your photos and content

You keep all rights to the photos and captions you upload. You give us a limited licence to store, process and display them only to provide the service to you and to people you share albums with. You confirm you have the right to upload everything you add, including permission from people who appear in your photos where required. Shared links can be viewed by anyone who has the link (and password, if set); you can stop sharing at any time.

If you believe content on My Album infringes your rights, email us and we will review and remove it where appropriate. Accounts that repeatedly infringe will be closed.

6. Acceptable use

You must not misuse My Album, including: using it for anything unlawful; uploading illegal content, content that sexualises minors, or content that harasses or exploits others; fraud or spam; infringing others' intellectual property; or interfering with security (malware, probing, scraping, or getting around plan limits). We may remove content that breaks these rules.

7. Our intellectual property

MaDare unipessoal LDA owns My Album, including its software, design, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use it within your plan. Do not copy, resell, or reverse engineer the service.

8. Payments, subscriptions and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, taxes, renewals, cancellations and refunds are governed by Paddle's Buyer Terms. The monthly subscription renews each month until cancelled; the one-time album purchase is charged once and does not renew. See our Refund Policy.

9. Availability

We work hard to keep My Album running and your photos safe, but we do not guarantee the service will be uninterrupted or error-free. We recommend keeping your own copies of your original photos. To the fullest extent permitted by law, the service is provided "as is" without implied warranties of merchantability or fitness for a particular purpose.

10. Suspension and termination

We may suspend or close accounts for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You can delete your account at any time from My albums; this permanently deletes your albums and photos.

11. Liability

Our total liability is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses such as lost profits, data or goodwill. Nothing limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited under law. You agree to indemnify us against claims arising from your content or your breach of these terms.

12. General

These terms are governed by Portuguese law, and the courts of Funchal, Madeira have jurisdiction, without affecting any mandatory consumer rights you have in your country. We are not responsible for delays caused by events beyond our reasonable control. We may update these terms and will notify you of material changes.
